The Ministry of State Properties and Land Affairs clarifies the legal distribution of properties belonging to foreigners in Tunisia. These properties are divided into agricultural lands and urban-type properties. Concerning agricultural lands, they are governed by Law 1964, a significant portion of which has been regularized and integrated into the national land registry, with ongoing efforts to transfer ownership of the remaining properties. As for urban-type properties, there are approximately 12,305 such properties. Of these, 7,645 have been allocated to French owners for the benefit of the state under historical agreements, while 4,660 remain under foreign ownership and are managed either by real estate agents or through specific legal instruments. Before 1956, ownership transfer or disposal of these properties required a license from the authorities. Special licensing procedures are also in place for non-resident foreign owners. The Tunisian real estate company oversees the management of the foreign property portfolio, conducting property auctions and ensuring legal oversight. It also monitors vacant properties and the renovation of dilapidated buildings to protect the rights of owners and stakeholders.
